Terms of Service

These Terms of Service (the “Terms”) govern your use of dodocast — the video hosting, 24/7 channel and broadcast platform available at dodocast.com, dodocast.ru and the dodocast console (the “Service”). The Service is operated by HWD Ltd., INN 6161062312, KPP 616101001, Tvorcheskaya St., Bldg. 9, Str. 1, Rostov-on-Don, Russian Federation (“dodocast”, “we”, “us”).

By creating an account or using the Service you accept these Terms. If you use the Service on behalf of an organisation, you confirm that you are authorised to accept them for that organisation.

1. Accounts

  • You must provide a valid email address and your name, and confirm the email address before using the Service. You may also sign in with a Google account.
  • You are responsible for keeping your credentials secret and for all activity under your account. Tell us immediately at hello@dodocast.com if you suspect unauthorised access.
  • You must be at least 18 years old, or the age of legal majority where you live.
  • One person or organisation may not create multiple accounts to obtain welcome bonuses or free plan limits more than once.

2. Plans, balance and billing

  • The Service is offered under plans (Free, Starter, Pro, Business and individual Enterprise terms). Current prices and limits are published at dodocast.com/#pricing and shown in the console.
  • Payments are made from a prepaid balance in your account. The monthly plan fee is charged from the balance; usage beyond the plan’s included volumes (delivery traffic, storage, stored video duration, transcoding, extra channels and other items) is charged at the published rates.
  • The billing cycle is the calendar month. Storage is charged daily based on the daily peak. Included volumes reset on the 1st day of each month.
  • Free plan limits are fixed and cannot be exceeded. A short dodocast pre-roll may be shown before videos on the Free plan.
  • When you change plan, the unused part of the previous plan may be credited to your balance as described in the console at the time of the change.
  • A welcome bonus, if offered, is promotional credit: it cannot be withdrawn or exchanged for money.
  • If your balance is insufficient, we may restrict uploads, broadcasts, channels or delivery until the balance is topped up. Content is not deleted immediately; see section 8.
  • Top-ups are processed by third-party payment providers. Unused balance is refunded on request, less bank and payment provider fees.
  • Prices exclude taxes unless stated otherwise. We may change prices with at least 30 days’ notice; changes do not affect a billing cycle already paid.

3. Your content

  • You keep all rights to the videos, audio, subtitles, images and other materials you upload (“Content”).
  • You grant us a worldwide, non-exclusive, royalty-free licence to host, store, transcode, encrypt, cache, reproduce and deliver your Content solely to operate the Service and deliver it to the audience you choose (links, embeds, channels and broadcasts).
  • You confirm that you own or have all rights and permissions needed for your Content, including music, third-party footage and personal images, and that its publication does not infringe anyone’s rights or the law.

4. Acceptable use

You may not use the Service to upload, broadcast or distribute Content that:

  • infringes copyright, trademarks or other rights of third parties;
  • is illegal in the country where it is published or viewed, including child sexual abuse material, terrorist or extremist content, and content inciting violence or hatred;
  • contains malware, phishing or spam;
  • re-streams third-party channels or events without the right to do so.

You may not attempt to bypass plan limits, access controls, encryption or link signing, overload the Service, or resell it without our written consent.

5. Moderation and notices

  • We may review, restrict or block Content and accounts that violate these Terms or the law, or upon a valid legal request. Where possible we will tell you the reason.
  • Rights holders can send infringement notices to hello@dodocast.com with the link to the material, proof of rights and contact details.

6. Availability

  • The Service is provided in early access. We work to keep it available but do not guarantee uninterrupted operation unless a separate service level agreement is signed (Enterprise).
  • We may change or discontinue features. Material changes that reduce paid functionality will be announced in advance.

7. Liability

  • The Service is provided “as is”. To the maximum extent permitted by law, we are not liable for indirect damages, lost profits or lost data.
  • Our total liability for any claim is limited to the amount you paid for the Service in the 3 months before the event giving rise to the claim.
  • Nothing in these Terms limits liability that cannot be limited under applicable law.

8. Termination

  • You may close your account at any time from the console or by writing to us.
  • We may suspend or close accounts that seriously or repeatedly violate these Terms.
  • After closure or prolonged negative balance, Content may be deleted after 30 days’ notice. Export your Content before closing the account.

9. Personal data

How we process personal data is described in the Privacy Policy.

10. Changes to these Terms

We may update these Terms. We will publish the new version on this page and notify you by email or in the console at least 14 days before material changes take effect. Continued use after that date means acceptance.

11. Governing law

These Terms are governed by the laws of the Russian Federation. Disputes are resolved by the courts at the operator’s location (Rostov-on-Don), unless mandatory consumer protection law provides otherwise.
